A federal court in Nigeria has ruled that authorities in Kano State and the Islamic religious police known as Hisbah cannot arrest a young woman because she converted from Islam to Christianity or refused a forced marriage.
The woman, identified publicly under the pseudonym “Sarah” for security reasons, is 22 years old. According to legal advocacy reporting, she fled her family home in 2025 after abuse from older siblings who were attempting to force her into marriage.
Sarah’s siblings reportedly worked with local Hisbah officers to have her detained. She was held for four days, beaten and pressured to accept the marriage she had rejected.
After her release, she found refuge with a Christian family and later converted to Christianity. Her siblings then accused the Christian family of kidnapping her after they helped her relocate to another state.
On May 26, 2026, a Federal High Court ruled in Sarah’s favor, restraining Kano State and the Hisbah from pursuing her arrest over either her conversion or her refusal to marry. The court described the actions against her as a violation of her rights to human dignity and freedom of religion and ordered financial compensation.
The ruling is significant because Hisbah units enforce Islamic moral codes in parts of northern Nigeria where Sharia-based legal structures operate alongside Nigeria’s federal constitutional system.
For Christians, the case highlights the practical meaning of freedom of religion: the ability not only to hold a belief privately but also to change one’s faith without arrest, coercion or violence.
The decision does not resolve every tension surrounding religious freedom in northern Nigeria, nor does it remove the security risks faced by converts. It does, however, establish an important judicial limit on the use of religious-police authority against an individual because of conversion.
